CLARIFICATION TEXT IN ACCORDANCE WITH THE LAW ON PROTECTION OF PERSONAL DATA

GENERAL EXPLANATION AND DEFINITIONS

This clarification text ("Clarification Text") has been prepared by our sole proprietorship Sebahattin Tuna Altın ("AutWorks" or "Company") with Tax ID No: 0610702289, located at Cevizli Mah. 30 Ağustos Cad. Dap Dalga Kule A Blok No: 13 A İç Kapı No: 92 Maltepe/ İstanbul, in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK"), as the data controller, within the scope of our commercial relations with you, within the framework of membership to our website ("Site") located at app.autworks.ai that we operate, and/or within our contractual relationship with you, in order to make explanations and inform you about the processing of your personal data.

The defined expressions in this notification text express the definitions specified in the KVKK and the legislation issued regarding the KVKK. Some defined expressions are as follows:

  • Explicit consent: Consent expressed with free will, based on information, regarding a specific subject,
  • Personal data: Any information relating to an identified or identifiable natural person,
  • Processing of personal data: Any operation performed on data such as obtaining, recording, storing, preserving, changing, rearranging, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data, either completely or partially automatically, or by non-automatic means provided that it is part of any data recording system,
  • Data processor: Real or legal person who processes personal data on behalf of the data controller based on the authority given by the data controller,
  • Data recording system: Recording system in which personal data are processed by being structured according to certain criteria,
  • Data controller: Real or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.

PERSONAL DATA TO BE PROCESSED

Unless otherwise expressly stated, the expression of personal data within the scope of the provisions and conditions presented within the scope of this Clarification Text will include the following information:

  • Category I: Identity and contact information (name, surname, e-mail, address and other information that members will provide about themselves, to be provided in the membership form and other fields)
  • Category II: Member information, member transaction information and financial information (membership information, membership ID number, data regarding the date and time of benefiting from our Company's services, credit purchase history, invoice and payment information, shared comments, artificial intelligence commands (prompts) and similar data)
  • Category III: Visual and Content Data (Raw images uploaded to the platform by the user, outputs created through artificial intelligence on these images, modeling data)
  • Category IV: Transaction security information (passwords, IP addresses)
  • Category V: Cookie records and all kinds of personal data obtained automatically or non-automatically due to the use of the Site, not limited to these

Our Company does not collect and process your special category personal data. Within the scope of your relationship with our Company - regardless of which communication method is used - please do not share your special category personal data.

PURPOSE OF PROCESSING PERSONAL DATA

Your personal data mentioned above are processed in the following direction for the purpose of using the Site, fulfillment of the Distance Sales Agreement between you and the Company, and benefiting from artificial intelligence services:

  • Management of artificial intelligence-supported image creation, model change, product photography and video production processes, making package and credit definitions, establishment and fulfillment of contracts,
  • Responding to calls and e-mails from you and meeting your help/support needs,
  • Ensuring control of our service quality, conducting customer satisfaction audits and increasing our service quality,
  • Conducting analyses for sales and marketing activities and financial planning purposes, updating the current operation, improving and updating our applications with internal and external human resource support,
  • Tracking your behavior on our applications and Site and providing you with personalized, faster and higher quality service based on these,
  • Exhibition of produced images (provided that they do not contain personal data) by AutWorks as "Sample Work" in marketing channels and conducting promotional activities,
  • Planning of the Company's strategies, management of communication with business partners and service providers, fulfillment of our legal and commercial obligations.

Your personal data may also be shared with relevant judicial authorities in order to exercise our right of legitimate defense in case our Company is a party to any dispute.

METHOD AND LEGAL BASIS OF PERSONAL DATA COLLECTION

Your personal data are collected through forms filled during membership to the Site, image upload processes, e-mail communication (support@autworks.com), social media channels and cookies. Your personal data are processed based on the following legal reasons specified under KVKK Article 5:

  • Being explicitly provided for in laws,
  • Being necessary for the processing of personal data, provided that it is directly related to the establishment or performance of a contract between the Member and the Company,
  • Being mandatory for the Company to fulfill its legal obligations,
  • Having been made public by you,
  • Being mandatory for the establishment, exercise or protection of a right,
  • Being mandatory for our legitimate interests (development of the system and ensuring security), provided that it does not harm your fundamental rights and freedoms.

TRANSFER OF PERSONAL DATA

Your personal data may be transferred to the following recipient groups in Turkey and (by obtaining your explicit consent) abroad, within the framework of KVKK Articles 8 and 9: Our business partners, server service providers where we store data in the cloud system, payment institution service providers, legally authorized public institutions and our relevant legal consultants if necessary.

RIGHTS OF THE PERSONAL DATA SUBJECT

Within the framework of KVKK Article 11, by applying to our Company, you have the right to learn whether data is processed, request information, learn the purpose of processing, know the third parties to whom data is transferred, request correction of incomplete/incorrect data, request deletion or destruction of data, and request compensation for damages suffered.

You can submit your requests in writing or through the e-mail address registered in our system. Our Company will finalize your application within thirty days at the latest, depending on the nature of the request.
