AUTWORKS TERMS OF USE AND MEMBERSHIP AGREEMENT

1. PARTIES AND ACCEPTANCE

This Terms of Use and Membership Agreement ("Agreement") has entered into force on the date it was approved electronically between Sebahattin Tuna Altın (hereinafter referred to as "AutWorks" or "Company") located at Cevizli Mah. 30 Ağustos Cad. Dap Dalga Kule A Blok No: 13 A İç Kapı No: 92 Maltepe/ İstanbul and the user ("Member") who is a member of the autworks.com website ("Site") or AutWorks mobile applications. By registering on the Site or using the services, the Member accepts, declares and undertakes that he has read, understood and is bound by all provisions of this Agreement.

2. DEFINITIONS

In the application and interpretation of this Agreement;

  • Platform: All web-based interfaces and software services operated by AutWorks,
  • Credit: Digital units purchased for the use of artificial intelligence tools within the Platform,
  • Content/Output: All kinds of results produced by artificial intelligence models from raw data (image, text, etc.) uploaded by the Member,
  • Force Majeure: Refers to extraordinary situations beyond the control of the Parties such as natural disasters, war, cyber attacks, server infrastructure failures.

3. MEMBERSHIP CONDITIONS AND ACCOUNT SECURITY

3.1. The Member undertakes that the name, surname and contact information provided during registration are current and accurate.

3.2. Membership account is personal; The Member cannot share his password with third parties. The Member is solely responsible for the security of the account and all transactions made through the account.

3.3. AutWorks reserves the right to suspend or permanently close the account in case of the Member's behavior contrary to laws or the agreement.

4. SERVICE USAGE AND CREDIT SYSTEM RULES

4.1. Dynamic Capabilities: AutWorks reserves the right to update the tools on the Platform (model, video, product photography, etc.) or add new features depending on technological developments.

4.2. Credit Spending Authority: The Company has the right to change the credit unit prices of features (e.g., from 2 credits to 3 credits) at any time according to the costs of artificial intelligence models and market conditions. The Member accepts the current credit tariff at the time of use in advance.

4.3. Credit Validity Period: Credits in purchased packages are limited to a 30 (Thirty) day usage period. Unused credits do not carry over to the next month and are deleted from the system at the end of the period.

5. INTELLECTUAL PROPERTY AND MARKETING AUTHORIZATION

5.1. All rights on the Platform interface, software codes and AutWorks trademark belong to Sebahattin Tuna Altın.

5.2. Marketing Authority: The Member accepts and declares that the images and outputs created on the Platform (provided that they do not contain personal data) can be used by AutWorks free of charge, indefinitely and worldwide as "Sample Work" on social media, website and digital channels for marketing, advertising and reference purposes.

6. CANCELLATION, REFUND AND RIGHT OF WITHDRAWAL

6.1. There is no right of withdrawal in digital content services. However, AutWorks grants the right to refund provided that no more than 72 hours have passed since the purchase and no credits have been used (0 credits) within the scope of customer satisfaction.

6.2. If even a single credit has been spent by logging into the system or if the 72-hour period has been exceeded, no refund will be made in any way.

7. PRIVACY AND DATA PROTECTION

7.1. AutWorks processes the Member's data within the framework of Law No. 6698 on the Protection of Personal Data and the Clarification Text.

7.2. Raw images uploaded to the system by the Member and artificial intelligence commands (prompts) are processed for the fulfillment of the service and the development of the system.

8. LIMITATION OF LIABILITY

8.1. AutWorks does not guarantee that artificial intelligence outputs have 100% accuracy or will fully meet the Member's commercial expectations.

8.2. In case the produced content violates the copyrights of third parties, the responsibility belongs to the Member who gives the command and produces the content.

9. MISCELLANEOUS PROVISIONS

9.1. Evidence Agreement: In disputes, AutWorks' database records and system logs are accepted as definitive evidence in accordance with HMK 193.

9.2. Notifications: Communication between the parties is provided via e-mail. AutWorks' contact address is support@autworks.com.

9.3. Competent Court: Consumer Arbitration Committees and Consumer Courts are authorized in disputes arising from this Agreement.
